Employment Law Advice for Employers
Employment law in the UK is constantly changing. For small and medium sized businesses it can be a nightmare keeping pace with the changes, particularly where your business is not large enough to support a dedicated HR professional. We can take the strain for you and provide you with up-to-date advice and practical guidance on how the changes affect your business and your managers and staff.
We can support you in specific cases, or provide general advice on improving your policies to ensure compliance. We can also provide training and development solutions to ensure your staff and managers understand the implications for the business and themselves of any changes to employment law.
We can support individual cases through to tribunal, including representation. We will prepare your case with the aim of minimising the potential costs of dealing with tribunal cases.
Legal costs can be unpredictable and if you do not carry specific insurance to cover the costs it is a matter of concern for many small businesses. Our commitment is to keep you informed of the costs involved at each stage and to work with you to find the most cost effective business solution for you and your business.
Employment Law Advice for Individuals
For individuals it can be a daunting and frightening prospect facing disciplinary action at work. If you want to talk through your situation and how to defend yourself we can help and advise you. We support individuals from the initial stages of disciplinary action, through appeal processes up to and including representation at tribunal.
Alternatively you may have a grievance or are being bullied at work, if so we can provide advice on how you should proceed or what rights you have.
Discipline, Grievance and Dispute Resolution
Minimum statutory disciplinary and grievance procedures were introduced from October 2004, and failure to follow these procedures could result in punitive financial penalties for employers at tribunals.
Executive Investigations
When there are issues or problems with senior executives these need to be handled with particular sensitivitiy both for the individual and for the organisation. We are experienced at working at board and chief executive level and can help to resolve the difficulties you face through investigations and where necessary negotiations.
Procedures - CashmoreJames will work with your organisation to ensure that your current procedures comply with the minimum statutory provision and can provide advice and guidance in individual cases.
Independent Investigations - We can provide an independent workplace investigation service where employee grievances are lodged or for disciplinary cases where you might prefer someone from outside your organisation to deal with particularly sensitive or complex investigations. Independent investigations can be particularly valuable in tribunal proceedings enabling you to show that an unbiased and independent investigation has taken place.
Training and Development - We can provide training courses for your managers on dealing effectively with grievance and disciplinary cases, bullying & harassment or conflict generally to ensure that as far as reasonably possible you avoid finding yourself facing a tribunal through failure to follow the minimum statutory provisions.
